1. Who we are
MindAlly (“we”, “us”) is a performance marketing and e-commerce growth agency. We run the website mindally.co and are responsible for the personal information described in this policy.
Our address is 1309 Coffeen Avenue, Ste 1200, Sheridan, WY 82801, United States.
For any privacy question or request, email hello@mindally.co.
2. What this policy covers
This policy covers information we collect when you visit our website, send us a message through our contact form, or contact us by email, phone or WhatsApp.
It does not cover:
- Data we handle on behalf of our clients while running their campaigns (for example, inside their ad accounts or customer lists). That is governed by our agreement with each client and by the client's own privacy policy.
- Other websites and platforms we link to, such as LinkedIn, Instagram or WhatsApp. They have their own policies.
3. Information we collect
Information you give us
We only receive personal information you choose to send us. Our website has no accounts or sign-ups.
Contact form. When you send a message through our contact form, we receive your name and email address, and, if you provide them, your company name, website, the services you're interested in, your monthly ad budget range and your message. The form sends these details to us by email. We don't store them in a database on our website.
Email, phone or WhatsApp. When you contact us directly, we receive your contact details and anything you include, such as your company, goals, ad budget or current results.
Please don't send us sensitive information (such as health or financial account details) unless we've specifically asked for it.
Information collected automatically
Like almost every website, our hosting provider's servers automatically record basic technical information when you visit, including your IP address, browser and device type, the pages you request, the page that referred you, and the date and time. We use these logs only to keep the site running, secure and free of errors.
To stop spam, our contact form keeps a scrambled (one-way encoded) version of your IP address on our server for a few minutes after you send a message, then deletes it, so the same visitor can't send many messages at once. It can't be turned back into your IP address.
Our website loads its fonts from Google Fonts. When it does, your browser connects to Google's servers, which receive your IP address and browser information. Google's use of that information is covered by the Google Privacy Policy.
4. Cookies and tracking
Our website does not currently set cookies and does not use analytics, advertising pixels or other tracking tools. We don't build profiles of visitors or show you ads based on your visit.
If we add analytics or advertising tools in future, we will update this policy first and, where the law requires it, ask for your consent before they run.
5. How we use your information
We use your information to:
- reply to your enquiry and arrange calls;
- prepare audits, proposals and agreements you ask for;
- provide our services if you become a client, including invoicing and account management;
- keep our website secure and working properly;
- meet our legal, tax and accounting obligations.
We don't add you to a mailing list or send you marketing emails unless you ask us to. If you do, you can unsubscribe at any time.
If you are in the European Economic Area or the United Kingdom, our legal bases are: taking steps at your request before entering a contract; our legitimate interests in responding to enquiries and running a secure website; compliance with legal obligations; and your consent where we ask for it.
6. Who we share it with
We do not sell or rent your personal information, and we do not share it for targeted advertising.
We share it only with:
- Service providers who help us run our business, such as our website host, email provider and file storage. They may only use it to provide their service to us.
- Professional advisers, such as accountants and lawyers, where needed.
- Authorities, when the law requires it or to protect our rights or someone's safety.
- A buyer or successor, if our business is merged, sold or restructured. This policy would continue to apply to your information.
7. International transfers
We and our service providers may store and process information in countries other than the one you live in, including the United States and India. Where the law requires it, we use appropriate safeguards for these transfers, such as standard contractual clauses.
8. How long we keep it
- Enquiries that don't lead to work together: up to 24 months after our last contact, then deleted.
- Client records: for as long as we work together, and afterwards for as long as tax, accounting or other laws require.
- Server logs: for a limited period set by our hosting provider, after which they are deleted automatically.
You can ask us to delete your information sooner (see section 10).
9. How we protect it
Our website uses an encrypted (HTTPS) connection. We limit access to personal information to people who need it, use reputable providers, and protect our accounts with strong passwords and two-factor authentication where available. No method of storage or transmission is completely secure, but we work to protect your information and will tell you and the relevant authorities about a breach where the law requires it.
10. Your rights
Depending on where you live, you may have the right to:
- ask what personal information we hold about you and get a copy;
- correct information that is wrong or incomplete;
- ask us to delete your information;
- object to or restrict how we use it;
- receive your information in a portable format;
- withdraw consent you've given, at any time;
- nominate someone to exercise your rights if you are unable to.
To use any of these rights, email hello@mindally.co. We'll reply within 30 days, and may need to confirm your identity first. We won't treat you differently for using your rights.
If you're unhappy with how we've handled your information, please contact us first so we can try to put it right. You can also complain to your local data protection authority — for example, a supervisory authority in the EEA, the Information Commissioner's Office in the UK, or the Data Protection Board of India.
11. Children
Our website and services are for businesses and are not directed at anyone under 18. We don't knowingly collect personal information from children. If you believe a child has sent us information, contact us and we'll delete it.
12. Links to other sites
Our website links to other sites and platforms, including the ad platforms whose logos we show. We're not responsible for how those sites handle your information, so please read their privacy policies.
13. Changes to this policy
We'll update this policy when our practices change, for example if we add analytics or a contact form. The date at the top shows when it was last updated. For significant changes, we'll make the update clear on our website.
